Deliver on human rights: Amnesty’s appeal to the UK Presidency of the EU

(Brussels, 28 June 2005) A strong human rights agenda can help the European Union overcome its political and institutional crisis and reaffirm the EU as a Union of values, says Amnesty International in its recommendations to the UK Presidency of the EU.

Amnesty International says its human rights proposals to the UK Presidency, released today in Brussels and London, add up to an ambitious program that would strengthen the EU’s leading role on human rights both at home and abroad.

Amnesty International EU Office Director Dick Oosting said:

“It is clear that the current EU crisis stems from a lack of vision of what the EU is actually for. By actively promoting the protection of human rights, the EU can project a convincing sense of purpose not only to its citizens but to the rest of the world. This will be a real test for the UK Presidency – to make the EU deliver on a strong human rights agenda.”

Amnesty International UK Director Kate Allen said:
“The UK should use its presidency to put the EU’s words into practice when it comes to human rights. And it must lead the EU by example – not just in areas where we have seen positive developments, such as arms control and freedom of expression, but also closer to home on issues like counter-terrorism and asylum.”

In its human rights recommendations, Amnesty International points out how the EU has taken a number of measures to strengthen its human rights capability over the past year. However, Amnesty’s assessment criticises the EU’s approach on issues such as counter-terrorism and asylum.

Amnesty International’s ten proposals for the UK Presidency of the EU:

At home:

1. Make the EU Fundamental Rights Agency the cornerstone of a proper fundamental rights order including full compliance by Member States;

2. Examine the threats to the balance between security and human rights and redress the human rights deficit in the EU’s counter-terrorism strategy;

3. Counter practices of unlawful detention and removal of foreign nationals from the EU;

4. Ensure scrupulous observance of the international protection obligations when developing the external dimension of asylum and immigration policies;

5. Promote the early ratification and implementation of the European Convention Against Trafficking.

In the world:

6. Press for more active implementation of the EU’s human rights foreign policy guidelines;

7. Reaffirm unequivocally the absolute prohibition of torture and other ill-treatment;

8. Press for a binding international Arms Trade Treaty;

9. Galvanise global support for UN reform towards the promotion and protection of human rights;

10. Assert a strong human rights dimension in the EU’s enlargement and neighbourhood policies.

Il faut des résultats en matière de droits humains : appel d’Amnesty International à la présidence britannique de l’Union européenne

(Bruxelles, 28 juin 2005) Un ordre du jour donnant une place importante aux droits humains pourrait aider l’Union européenne (UE) à surmonter sa crise politique et institutionnelle et à réaffirmer les valeurs qui font d’elle une union. C’est ce qu’affirme Amnesty International dans ses recommandations à la présidence britannique de l’UE.

Les propositions d’Amnesty International relatives aux droits humains, rendues publiques à Bruxelles et Londres ce mardi 28 juin 2005, constituent un programme ambitieux susceptible de renforcer le rôle directeur de l’UE  en matière de droits humains tant à l’intérieur qu’à l’extérieur de l’Europe.

Pour Dick Oosting, directeur du bureau européen d’Amnesty International, “ il est clair que la crise de l’Union vient d’un manque de compréhension de son utilité. En promouvant la protection des droits humains, l’Union européenne ferait apparaître une orientation claire non seulement à ses citoyens mais aussi au reste du monde. Il s’agira d’un véritable test pour la présidence britannique – faire en sorte que l’UE tienne ses promesses sur un programme accordant une place importante aux droits humains.”

Selon Kate Allen, directrice de la section britannique d’Amnesty International :
“ Le Royaume-Uni devrait mettre à profit sa présidence pour traduire en actes les prises de position de l’UE en matière de droits humains. Il s’agira de montrer l’exemple – pas seulement dans les domaines dans lesquels nous avons constaté une évolution positive, comme le contrôle des armes et la liberté d’expression, mais aussi dans des secteurs comme le contre-terrorisme et l’asile. ”

Dans ses recommandations, Amnesty International note que l’UE a pris au cours de l’année un certain nombre de mesures pour renforcer sa capacité à traiter les questions relatives aux droits humains.

Cependant, elle critique l’approche adoptée par l’UE en matière de contre-terrorisme et d’asile, par exemple.

Les dix  propositions d’Amnesty International à la présidence britannique de l’UE sont les suivantes :

À l’intérieur de l’Union :

1. Faire de l’Agence des droits fondamentaux de l’UE la pierre angulaire d’un véritable ordre relatif aux droits fondamentaux, auquel tous les États membres devront se conformer ;

2. examiner les points qui menacent l’équilibre entre sécurité et droits humains et pallier au déficit constaté en matière de droits fondamentaux dans la stratégie de lutte contre le terrorisme de l’UE ;

3. lutter contre les pratiques illégales de détention et de renvoi des ressortissants étrangers ;

4. veiller à ce que soient observées scrupuleusement les obligations internationales de protection lors de l’élaboration de politiques d’immigration et d’asile ;

5. promouvoir une prompte ratification et mise en application de la Convention européenne contre le trafic d’êtres humains.

Dans le monde :

6. Faire pression pour une application plus active des lignes directrices de l’UE en matière de droits humains pour ce qui touche à la politique étrangère ;

7. réaffirmer sans équivoque l’interdiction absolue de la torture et des autres mauvais traitements ;

8. faire pression en faveur d’un traité international juridiquement contraignant sur le commerce des armes ;

9. susciter un soutien mondial en faveur d’une réforme des Nations unies qui favorise la promotion et la protection des droits humains ;

10. affirmer avec force l’importance des droits humains dans l’élargissement de l’UE et les relations avec les pays proches.

(بروكسيل، 26 يونيو/حزيران 2005) يمكن لأجندة قوية لحقوق الإنسان أن تساعد الاتحاد الأوروبي على التغلب على أزمته السياسية والمؤسسية، وعلى إعادة التأكيد على الاتحاد الأوروبي بصفته اتحاداً للقيم – هذا ما أكدت عليه منظمة العفو الدولية في توصياتها التي تقدمت بها إلى رئاسة المملكة المتحدة للاتحاد الأوروبي.

وتقول منظمة العفو الدولية إن مقترحاتها المتعلقة بحقوق الإنسان التي قدمتها إلى رئاسة المملكة المتحدة، ونشرت اليوم في بروكسيل ولندن، تشكل إضافة لبرنامج طموح من شأنه أن يعزز الدور القيادي للاتحاد الأوروبي في ميدان حقوق الإنسان سواء داخل الاتحاد نفسه أم خارج حدوده.

وفي هذا السياق، قال مدير مكتب الاتحاد الأوروبي لمنظمة العفو الدولية، ديك أوستينغ: "من الواضح أن الأزمة الراهنة للاتحاد الأوروبي تنبع من غياب الرؤية بشأن ما الذي يُراد من الاتحاد الأوروبي فعلياً. وبتعزيزه النشط لحماية حقوق الإنسان، يمكن للاتحاد الأوروبي أن يبث شعوراً مقنعاً بالجدوى ليس فحسب لدى مواطنيه وإنما في باقي أرجاء العالم. وستشكل هذه القضية محكاً حقيقياً لرئاسة المملكة المتحدة للاتحاد كي تقود الاتحاد الأوروبي نحو اعتماد أجندة قوية لحقوق الإنسان".

وقالت مديرة فرع المملكة المتحدة لمنظمة العفو، كيت ألين :

"ينبغي أن تستخدم المملكة المتحدة فترة رئاستها لترجمة كلام الاتحاد الأوروبي إلى ممارسة عندما يصل الأمر إلى حقوق الإنسان". وعليها أن تقود الاتحاد الأوروبي عن طريق لعب دور المثال الذي يقتدى "ليس فحسب في المجالات التي تحققت فيها تطورات إيجابية، من قبيل الرقابة على الأسلحة وحرية التعبير، وإنما أيضاً داخل أراضيها نفسها، وبالنسبة لقضايا من قبيل مكافحة الإرهاب واللجوء".

وتشير منظمة العفو الدولية في توصياتها بشأن حقوق الإنسان إلى عدد من التدابير التي اتخذها الاتحاد الأوروبي لتقوية قدراته في مضمار حقوق الإنسان في السنة الماضية. بيد أن تقويم منظمة العفو يوجه النقد إلى "نهج الاتحاد الأوروبي في التعامل مع قضايا من قبيل مكافحة الإرهاب واللاجئين".

وتضمنت مقترحات منظمة العفو الدولية العشرة لرئاسة المملكة المتحدة للاتحاد الأوروبي ما يلي:

داخل الدول الأعضاء في الاتحاد:

1. جعل وكالة الاتحاد الأوروبي للحقوق الأساسية حجر الأساس لنظام مناسب للحقوق الأساسية يتضمن تقيد الدول الأعضاء الكامل بها؛

2. تفحُّص مصادر التهديد للتوازن بين الأمن وحقوق الإنسان ومعالجة أوجه العجز المتعلقة بحقوق الإنسان في استراتيجية الاتحاد الأوروبي لمكافحة الإرهاب؛

3. الوقوف ضد ممارسات الاعتقال غير المشروعة وضد إبعاد مواطني الدول الأجنبية من الاتحاد الأوروبي؛

4. ضمان التقيد الحريص بالالتزامات الدولية للحماية لدى صياغة البعد الخارجي لسياسات اللجوء والهجرة؛

5. تعزيز عملية التصديق المبكر على الاتفاقية الأوروبية ضد الاتجار بالبشر، ووضعها موضع التنفيذ.

على الصعيد العالمي:

6. ممارسة الضغوط من أجل التنفيذ النشط للمبادئ التوجيهية لسياسة الاتحاد الأوروبي الخارجية المتعلقة بحقوق الإنسان؛

7. التأكيد مجدداً وبصورة صريحة على الحظر المطلق للتعذيب وإساءة المعاملة؛

8. ممارسة الضغوط من أجل عقد معاهدة دولية ملزمة بشأن تجارة الأسلجة؛

9. حشد الدعم العالمي لإصلاح الأمم المتحدة في اتجاه تعزيز حقوق الإنسان وحمايتها؛

10. التأكيد على بعد قوي لحقوق الإنسان في عملية توسيع الاتحاد الأوروبي وسياسات الجوار.
